DOE Issues Proposed Rule on Whistleblower Retaliation by Contractors

In response to a scathing report by the Government Accountability Office (GAO), the Department of Energy has issued a proposed rule “clarifying that the Department can assess civil penalties against contractors and subcontractors for retaliating against any employee who raises concerns relating to nuclear safety.” The DOE is accepting comments on this proposed rule via email: [email protected] More information on how to file a comment can be found in the notice linked here. Las Vegas Sands Paying Penalty for FCPA Violations

On April 7, 2016 the Securities and Exchange Commission announced that Las Vegas Sands Corp. agreed to pay a $9 million penalty to settle charges that it violated the Foreign Corrupt Practices Act (FCPA) by failing to properly authorize or document millions of dollars in payments to a consultant facilitating business activities in China and Macao. An SEC investigation found that LVS kept inaccurate books and records and frequently lacked supporting documentation or proper approvals for more than $62 million in payments to a consultant in Asia. The consultant acted as an intermediary to obscure the company’s role in certain business transactions such as the purchases of a basketball team and a building in China, where casino gambling isn’t permitted. Social Security Administration Whistleblower Seeks Restraining Order

The Wisconsin Watchdog reports today that a manager at the Madison, Wi Office of Disability Adjudication and Review was granted a temporary restraining order against another manager in the office. The whistleblower, Deborah Holland, claims she has been repeatedly harassed and retaliated against since she filed a misconduct complaint last year. According to WisconsinWatchdog.org "Holland and whistleblowers allege there is a culture of corruption and cover-up at the Madison office, which reviews Social Security benefits claims." Our Client Received the Largest Whistleblower Reward in World History of $104 Million

Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Mr. Birkenfeld obtained the largest ever individual qui tam whistleblower award in history, $104 million.

Dedicated to protecting whistleblowers, the National Whistleblower Center (NWC) was founded in 1988 by three experienced whistleblower-rights attorneys, Stephen M. Kohn, Michael D. Kohn and David K. Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC. She currently is the NWC corporate Treasure and serves on its Board of Directors. She founded the whistleblower protection blog, and for years managed many of the NWC's highly successful programs.
