Former Company Officer Earns Half-Million Dollar Whistleblower Award for Reporting Fraud Case to SEC

The Securities and Exchange Commission today announced a whistleblower award payout between $475,000 and $575,000 to a former company officer who reported original, high-quality information about a securities fraud that resulted in an SEC enforcement action with sanctions exceeding $1 million. Officers, directors, trustees, or partners who learn about a fraud through another employee reporting the misconduct generally aren’t eligible for an award under the SEC’s whistleblower program. However, there is an exception to this exclusion that makes an officer eligible if he or she reports the information to the SEC more than 120 days after other responsible compliance personnel possessed the information and failed to adequately address the issue. UBS Whistleblower Pushed Hard to Help French Investigation

The Wall Street Journal reports that UBS whistleblower, Bradley Birkendfeld, who will aid a current French probe of UBS, had to push hard to win permission to do so. His information forced Switzerland to change its international treaty with the United States resulting and its largest bank was forced to turn over the names of over 4,900 U.S. citizens who held illegal offshore accounts. Mr. Birkenfeld received a $104 million IRS Whistleblower reward – the largest ever received by an individual whistleblower. Senate to Hold Hearing on FBI’s Treatment of Whistleblowers

Washington, D.C. February 27, 2015. The Senate Judiciary Committee will hold a hearing entitled “Whistleblower Retaliation at the FBI: Improving Protections and Oversight,” on Wednesday, March 4, 2015, at 10 am in the Committee’s main hearing room, 226 Dirksen. Witnesses include the Department of Justice Inspector General, a current FBI whistleblower and Stephen M. Kohn, Executive Director of the National Whistleblower Center and author of The Whistleblower’s Handbook. According to Kohn, “This hearing will be an eye opener to the internal operations of the FBI.” Mr. Kohn has represented FBI whistleblowers continuously since 1993 and was lead counsel on the case of Whitehurst v. FBI, which compelled President Clinton to order the DOJ to implement whistleblower protections in 1997. Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Mr. Birkenfeld obtained the largest ever individual qui tam whistleblower award in history, $104 million.

Dedicated to protecting whistleblowers, the National Whistleblower Center (NWC) was founded in 1988 by three experienced whistleblower-rights attorneys, Stephen M. Kohn, Michael D. Kohn and David K. Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC. She currently is the NWC corporate Treasure and serves on its Board of Directors. She founded the whistleblower protection blog, and for years managed many of the NWC's highly successful programs.
