Fault Lines Reports on Flawed FBI Hair Analyses

On August 17, 2015, Kohn, Kohn & Colapinto partner David K. Colapinto and his client FBI whistleblower Dr. Frederic Whitehurst appeared on the Al-Jazeera America program Fault Lines. “Under the Microscope: The FBI Hair Cases” discussed the flaws in the U.S. Federal Bureau of Investigation crime lab’s hair analyses. In April 2015 the FBI admitted the FBI Lab’s forensic hair analyses used for decades in state and federal criminal cases were flawed and inaccurate more that ninety percent (90%) of the time. Dr. Whitehurst first raised these systemic problems at the FBI Lab more than 20 years ago. The recent reviews reported by the Washington Post in April were the direct result of Dr. Whitehurst’s initial whistleblower disclosures between 1995-1997. The Department of Justice announced settlements in the following False Claims Act lawsuits: Government Settles False Claims Act Allegations against Florida Neurologist for $150,000 Dr. Sean Orr of Jacksonville, Florida, has agreed to pay $150,000 to settle allegations that he violated the False Claims Act by providing medically unnecessary services and drugs to federal health care program beneficiaries, the Department of Justice announced. Dr. Orr is a neurologist formerly employed by Baptist Neurology Inc. and Baptist Medical Center-Jacksonville. Medco to Pay $7.9 Million to Resolve Kickback Allegations Medco Health Solutions Inc., a wholly-owned subsidiary of the pharmacy benefit manager Express Scripts Holding Company, of Missouri, has agreed to pay the government $7.9 million to settle allegations that it engaged in a kickback scheme in violation of the False Claims Act, the Justice Department announced. Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Dedicated to protecting whistleblowers, the National Whistleblower Center (NWC) was founded in 1988 by three experienced whistleblower-rights attorneys, Stephen M. Kohn, Michael D. Kohn and David K. Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC. She currently is the NWC corporate Treasure and serves on its Board of Directors. She founded the whistleblower protection blog, and for years managed many of the NWC's highly successful programs.
