Milestone Whistleblower Award by SEC to Company Outsider

Washington, D.C. January 15, 2016. The Securities and Exchange Commission issued a landmark award to an industry expert who provided it with “high-quality analysis” in an enforcement action. The whistleblower award of more than $700,000 marks the first time the SEC has issued an award to someone outside a company since the whistleblower office opened in 2011. The SEC did not identify the outsider or the company involved in the case, as the SEC protects the confidentiality of whistleblowers and does not disclose information that might directly or indirectly reveal a whistleblower’s identity. “The voluntary submission of high-quality analysis by industry experts can be every bit as valuable as first-hand knowledge of wrongdoing by company insiders,” said Andrew Ceresney, Director of the SEC’s Enforcement Division. “We will continue to leverage all forms of information and analysis we receive from whistleblowers to help better detect and prosecute federal securities law violations.” ...

Important Breakthrough “Game-Changer” for Protecting the Environment

The Environmental Law Reporter published an article that explains how the monetary rewards provisions for whistleblowers in both the Lacey Act and the Endangered Species Act can have a massive impact on the detection and deterrence of wildlife crimes. The article, “Monetary Rewards for Wildlife Whistleblowers: A Game-Changer in Wildlife Trafficking Detection and Deterrence," published on January 1, 2016 was written by Kohn, Kohn & Colapinto partner Stephen M. Kohn. In the article, Kohn calls on Congress to step in to ensure the responsible federal agencies implement these provisions that were passed into law over thirty years ago. Kohn explains the history of the wildlife whistleblower reward provisions and discusses current process for monetary whistleblower rewards administered by the SEC and IRS. When effectively implemented, these provisions will provide a new area of protections for whistleblowers that never existed. Our Client Received the Largest Whistleblower Reward in World History of $104 Million

Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Mr. Birkenfeld obtained the largest ever individual qui tam whistleblower award in history, $104 million.

Dedicated to protecting whistleblowers, the National Whistleblower Center (NWC) was founded in 1988 by three experienced whistleblower-rights attorneys, Stephen M. Kohn, Michael D. Kohn and David K. Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC. She currently is the NWC corporate Treasure and serves on its Board of Directors. She founded the whistleblower protection blog, and for years managed many of the NWC's highly successful programs.
