$17 Million Whistleblower Award Issued by SEC to Former Company Employee

Washington D.C., June 9, 2016. The Securities and Exchange Commission has issued a whistleblower award of over $17 million to a former company employee who provided a tip that led to a successful SEC investigation and enforcement action. This is the second-highest amount awarded to a whistleblower by the agency since they first since they opened their whistleblower office in 2011. Andrew Ceresney, Director of the SEC’s Division of Enforcement made the following statement regarding the award: “Company insiders are uniquely positioned to protect investors and blow the whistle on a company’s wrongdoing by providing key information to the SEC so we can investigate the full extent of the violations. UBS Whistleblower Calls for Switzerland to Make Changes to Protect Whistleblowers

Swiss bank whistleblower Bradley Birkenfeld was featured yesterday in an article detailing the extremely hostile environment that exists in Switzerland toward whistleblowers. In the article Birkenfeld states that change is “long overdue” for the country which has prosecuted several whistleblowers in recent years. Switzerland lawmakers have drafted whistleblower legislation which has been strongly criticized as being "even worse" as having no law. The draft law would require employees to report concerns to their companies first and then wait 60 days to see if any action is taken before they could contact a government authority to make a report. The draft law does not contain any protection from retaliation for employees. Our Client Received the Largest Whistleblower Reward in World History of $104 Million

Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Mr. Birkenfeld obtained the largest ever individual qui tam whistleblower award in history, $104 million.

Dedicated to protecting whistleblowers, the National Whistleblower Center (NWC) was founded in 1988 by three experienced whistleblower-rights attorneys, Stephen M. Kohn, Michael D. Kohn and David K. Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC. She currently is the NWC corporate Treasure and serves on its Board of Directors. She founded the whistleblower protection blog, and for years managed many of the NWC's highly successful programs.
