Company Insider Receives Whistleblower Award of More Than Half-Million Dollars

An employee turned whistleblower after witnessing securities violations within their company. The whistleblower reported the wrongdoing to the Securities and Exchange Commission (SEC) who categorized the violations as “hard-to-detect violations of the securities laws.” The whistleblower was awarded more than $500,000 for reporting information that prompted an SEC investigation into the well-hidden misconduct that resulted in an SEC enforcement action. “Company insiders are in a unique position to provide specific information that allows us to better protect investors and the marketplace.  We encourage insiders with information to bring it to our attention,” said Jane Norberg, Chief of the SEC’s Office of the Whistleblower, in today’s announcement. House Passes Bill to Clarify Whistleblower Protection for Federal Employees

Monday the House of Representatives passed the Follow the Rules Act, H.R. 657.  The bill, introduced by Representatives Sean Duffy (R-WI) and Gerry Connolly (D-VA), aims to address a misinterpretation of the Whistleblower Protection Act by the U.S. Court of Appeals for the Federal Circuit in the case of Rainey v. MSPB. This bill clarifies that under the WPA, employees are protected against retaliation for refusing to obey an order that would require them to violate a law, rule or regulation. President Trump Creates Whistleblower Office at VA

Whistleblower advocates remain cautious awaiting critical appointments to OSC & MSPB. Yesterday President Donald Trump signed an executive order establishing a whistleblower office at the Department of Veterans Affairs (VA). The VA has been embroiled in controversy since news broke in 2014 that veterans had died while on waiting lists for appointments at the VA Hospital in Phoenix. The executive order, “Improving Accountability and Whistleblower Protection,” establishes an office, which will report directly to Secretary David Shulkin, to investigate allegations of misconduct, including whistleblower retaliation. “With the creation of this office, we are sending a strong message: Those who fail our veterans will be held, for the first time, accountable,” President Trump stated. Our Client Received the Largest Whistleblower Reward in World History of $104 Million

Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Mr. Birkenfeld obtained the largest ever individual qui tam whistleblower award in history, $104 million.

Dedicated to protecting whistleblowers, the National Whistleblower Center (NWC) was founded in 1988 by three experienced whistleblower-rights attorneys, Stephen M. Kohn, Michael D. Kohn and David K. Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC. She currently is the NWC corporate Treasure and serves on its Board of Directors. She founded the whistleblower protection blog, and for years managed many of the NWC's highly successful programs.
