House Committee Approves Three Bills to Strengthen Whistleblower Protections

On Tuesday, May 2, 2017, the House Oversight and Government Reform Committee approved three bills aimed to increase protections for whistleblowers. “Whistleblowers must be protected. Period. Their courageous efforts keep the federal government open and honest. Passing these bipartisan bills illustrates our commitment to protecting a whistleblower’s right to report information,” said Chairman Jason Chaffetz. “These bills send a strong message that we have the backs of whistleblowers,” said Ranking Member Elijah Cummings. “It is unacceptable that agencies stonewall OSC investigations by withholding critical information. I thank Chairman Chaffetz, Ranking Member Cummings, and other co-chairs of the House Whistleblower Protection Caucus for their support of this bill that clarifies that the OSC does have the authority to obtain documents relevant to their investigations,” said Congressman Rod Blum. Government Intervenes in Whistleblower’s False Claims Lawsuit Against UnitedHealth Group

Monday, the Department of Justice announced it had intervened in a lawsuit against UnitedHealth Group (UHG) that alleges UHG obtained inflated risk adjustment payments based on untruthful and inaccurate information about the health status of beneficiaries enrolled in UHG’s largest Medicare Advantage Plan, UHC of California. UHG, through more than 50 Medicare Advantage and Drug Prescription plans, receives a monthly payment from Medicare for each beneficiary that is based, in significant part, on the health status of the beneficiary. The government’s complaint alleges that although UHG contractors conducted chart reviews for each beneficiary, it knowingly disregarded from these chart reviews about invalid diagnoses and thus avoided repaying Medicare monies to which it was not entitled. “The intervention of the United States in this matter illustrates our commitment to ensure the integrity of the Medicare Part C program,” said Acting Assistant Attorney General Chad A. Readler of the Justice Department’s Civil Division. ...

Campaign to Save Dodd-Frank Whistleblowing Intensifies

May 3, 2017. Washington, D.C.  The nonprofit National Whistleblower Center (NWC) has intensified its educational campaign urging the U.S. Congress to preserve all the protection afforded Wall Street whistleblowers under the Dodd-Frank Act. The House Financial Services Committee is meeting today and anticipates it will vote tomorrow on the Financial CHOICE Act, the Republican initiative to repeal the Dodd-Frank Act. As of 3 pm (EST), the NWC reports over 31,000 messages were sent to members of the House and Senate urging them not to undermine the whistleblower provisions of the Dodd-Frank Act. Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Mr. Birkenfeld obtained the largest ever individual qui tam whistleblower award in history, $104 million.

Dedicated to protecting whistleblowers, the National Whistleblower Center (NWC) was founded in 1988 by three experienced whistleblower-rights attorneys, Stephen M. Kohn, Michael D. Kohn and David K. Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC. She currently is the NWC corporate Treasure and serves on its Board of Directors. She founded the whistleblower protection blog, and for years managed many of the NWC's highly successful programs.
