Whistleblower Advocate Weighs in on Canada’s Whistleblower Reward Program

Leading international whistleblower attorney Stephen M. Kohn, says it’s too early to tell if Canada’s whistleblower incentive program will be a success.  The Ontario Securities Commission’s program has flaws according to Kohn, a partner in the Washington, D.C. based law firm of Kohn, Kohn & Colapinto. “These flaws may hinder the success of the program,” Kohn said during a panel discussion sponsored by the University of Toronto’s Rotman School of Management in January 2017. The flaws Kohn points to the $5-million cap on possible payouts by the program, saying it will hamper the program as the “big fish” will not come forward. He also pointed out that there is no minimum reward level to provide prospective tipsters assurances they will get a reward if they are entitled. NWC highlights former FBI Director James Comey’s remarks on National Whistleblower Day 2016. The National Whistleblower Center (NWC) issued an action alert today asking its supporters to "Stand Up for Whistleblowers!" The campaign highlights the 2016 Whistleblower Day remarks of former FBI Director James Comey.   Comey gave his remarks at a Whistleblower Day celebration, sponsored by the Council on Inspectors General for Integrity and Efficiency (CIGIE) on August 1, 2016.  Leaders from four federal agencies (the FBI, the Council on Inspectors General for Integrity and Efficiency, the Office of the Special Prosecutor, and the Occupational Safety and Health Administration) came together to formally acknowledge the important contributions and sacrifices made by whistleblowers.  The event kicked off with remarks from then FBI Director James Comey who acknowledged the importance of creating a culture where whistleblowers feel they can be heard.  Listen to Comey's full remarks here. On January 26, 2017, whistleblower attorney Stephen Kohn participated in a panel discussion at the University of Toronto’s Capital Markets Institute on the topic of “Rewarding Corporate Whistleblowers: Will this Improve Canadian Capital Markets?” Kohn, who is a partner in the international whistleblower firm Kohn, Kohn and Colapinto, LLP, was co-counsel to Swiss Bank whistleblower Bradley Birkenfeld in his successful IRS whistleblower reward case and serves as the Executive Director of the National Whistleblower Center (US). Birkenfeld won the highest individual reward in history, $104 million. Our Client Received the Largest Whistleblower Reward in World History of $104 Million

Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Mr. Birkenfeld obtained the largest ever individual qui tam whistleblower award in history, $104 million.

Dedicated to protecting whistleblowers, the National Whistleblower Center (NWC) was founded in 1988 by three experienced whistleblower-rights attorneys, Stephen M. Kohn, Michael D. Kohn and David K. Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC. She currently is the NWC corporate Treasure and serves on its Board of Directors. She founded the whistleblower protection blog, and for years managed many of the NWC's highly successful programs.
