Kohn Explains Effectiveness of Whistleblower Incentives to Root Out Corporate Fraud

In a May 23, 2017, blog post on Pro-Market, the blog of the Stigler Center at the University of Chicago Booth School of Business, leading whistleblower attorney Stephen Kohn explored the findings of a 2008 ground-breaking study regarding the “most effective mechanisms for detecting corporate fraud.”  The study found that monetary rewards had a “significant impact” on the probability of someone becoming a whistleblower. “Who Blows the Whistle on Corporate Fraud?” published in 2008 by the University of Chicago Booth School of Business, was used by the Securities and Exchange Commission (SEC) when implementing rules for the Dodd-Frank Act, according to Kohn. Kohn’s blog post explains the importance of the study and the success of whistleblower incentive laws in rooting out corporate fraud. CFTC Expands Whistleblower Protections

On Monday, the U.S. Commodity Futures Trading Commission (CFTC) announced changes to its whistleblower rules that will provide better protection for whistleblowers against retaliation. The improved rules also strengthen the process for reviewing whistleblower claims. The changes will now allow either the CFTC or the whistleblower to bring a claim against an employer for retaliation. The amendments also prohibit employers from preventing would-be whistleblowers from reaching out directly to the CFTC. “The Whistleblower Program is an integral part of the Division’s efforts to identify and prosecute unlawful conduct. The Commission’s approval of these rules today will further strengthen and enhance our efforts to protect customers and promote market integrity,” said James McDonald, the Director of the Division of Enforcement. Whistleblower Awarded $1.8 Million for Reporting Medicare Fraud

On April 25, 2017, the Department of Justice (DOJ) announced that Braden Partners, L.P., doing business as Pacific Pulmonary Services (PPS), paid $11.4 million to resolve allegations it violated the False Claims Act.  California-based PPS furnishes stationary and portable oxygen tanks and related supplies, and sleep therapy equipment, such as Continuous Positive Airway Pressure, Bi-level Positive Airway Pressure masks and related supplies, to patients’ homes in California and other states. A whistleblower, Manuel Alcaine, who is a former PPS sales representative, alleged PPS had submitted claims for reimbursement to Medicare and other federal healthcare programs for oxygen and related equipment supplied in violation of program rules, and for sleep therapy equipment supplied as part of a cross-referral kickback scheme with sleep clinics. Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Mr. Birkenfeld obtained the largest ever individual qui tam whistleblower award in history, $104 million.

Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC.
