Whistleblowers Receive $9.67 Million for Blowing the Whistle on Fraud in Government Health Care Programs

On June 16, 2017, the Department of Justice announced that Genesis Healthcare, Inc. (Genesis) has agreed to pay the federal government $53639,288.04, including interest, to settle six lawsuits, brought by seven whistleblowers, that allege companies and facilities acquired by Genesis violated the False Claims Act (FCA). The six lawsuits allege that the companies and facilities acquired by Genesis caused the submission of false claims to government health care programs for medically unnecessary therapy and hospice services, and grossly substandard nursing care. The four sets of allegations in the lawsuits include, billing for hospice services for patients who were not terminally ill, billing for more therapy minutes than the patients received, billing for outpatient therapy services that were not medically necessary, and billing for programs at certain of its nursing homes for services that were grossly substandard and/or worthless and therefore ineligible for payment. “We will continue to hold health care ...

Whistleblower Rewarded for Reporting Scheme to Pay Kickbacks for Unnecessary Blood Tests

The Department of Justice announced on April 28, 2017, that Quest Diagnostics Inc. agreed to pay $6 million to resolve a False Claims Act (FCA) lawsuit that alleged Berkeley HeartLab Inc., of Alameda, California, violated the FCA by paying kickbacks to physicians and patients to induce the use of Berkeley for blood testing services and by charging for medically unnecessary tests. Quest, which is headquartered in Madison, New Jersey, acquired Berkeley in 2011, and ended the conduct that gave rise to the settlement. Physicians refer their patients to independent laboratories like Berkeley to conduct tests on blood samples. According to the government’s complaint, Berkeley paid kickbacks to referring physicians disguised as “process and handling” fees. The complaint also alleged that Berkeley paid kickbacks to patients by routinely waiving copayments owed by certain patients who were legally required to pay for part of their tests. Our Client Received the Largest Whistleblower Reward in World History of $104 Million

Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Mr. Birkenfeld obtained the largest ever individual qui tam whistleblower award in history, $104 million.

Dedicated to protecting whistleblowers, the National Whistleblower Center (NWC) was founded in 1988 by three experienced whistleblower-rights attorneys, Stephen M. Kohn, Michael D. Kohn and David K. Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC. She currently is the NWC corporate Treasure and serves on its Board of Directors. She founded the whistleblower protection blog, and for years managed many of the NWC's highly successful programs.
