Whistleblower Helps Combat Healthcare Fraud – is Rewarded in Qui Tam Lawsuit Alleging Medicare Fraud at Banner Health

Whistleblower law firm Kohn, Kohn & Colapinto congratulates qui tam whistleblower Cecilia Guardiola for helping the federal government combat Medicare fraud.  Ms. Grardiola will receive approximately $3.3 million out of the $18 million settlement the Department of Justice announced on April 12, 2018.  Ms. Guardiola, a former employee of Banner Health, filed a lawsuit under the qui tam provision of the False Claims Act (FCA).  The lawsuit alleged that Banner Health knowingly submitted false claims to Medicare by admitting patients at 12 of its hospitals who could have been treated as outpatients.  The $18 million settlement also resolves allegations that Banner Health inflated in reports to Medicare the number of hours for which patients received outpatient observation care during this time. April 13, 2018, Washington, D.C.  As part of KKC’s mission of rooting out corporate fraud and foreign corruption, whistleblower attorney Michael Kohn, who is a KKC partner and President of the National Whistleblower Center, met with a delegation of representatives from India, Maldives, Nepal, Pakistan, and Sri Lanka. Facebook Whistleblower Alleges Company Chooses to Profit from The Trafficking of Endangered Species

Washington, D.C. April 10, 2018.  The whistleblower law firm of Kohn, Kohn and Colapinto announced today that it filed the anonymous whistleblower complaint against Facebook with the U.S. Securities and Exchange Commission Office of the Whistleblower alleging that Facebook is knowingly profiting from the trafficking of endangered species.  The complaint, filed with the SEC in August of 2017, explains how Facebook failed to implement the necessary and required internal controls to curtail criminal activity occurring on Facebook’s social media pages.  The complaint explains how Facebook is engaged in the business of selling advertisements on the web pages it knows or should have known were being used by traffickers to market endangered species animal parts.  “Extinctions are forever so it is an urgent necessity to stop the trafficking on Facebook of critically endangered species immediately and forever,” said Stephen M. Our Client Received the Largest Whistleblower Reward in World History of $104 Million

Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Mr. Birkenfeld obtained the largest ever individual qui tam whistleblower award in history, $104 million.

Dedicated to protecting whistleblowers, the National Whistleblower Center (NWC) was founded in 1988 by three experienced whistleblower-rights attorneys, Stephen M. Kohn, Michael D. Kohn and David K. Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC. She currently is the NWC corporate Treasure and serves on its Board of Directors. She founded the whistleblower protection blog, and for years managed many of the NWC's highly successful programs.
