Danske Bank Whistleblower Releases Slides from his EU Parliament Presentation

The full terms of Wilkinson's restrictive NDA are disclosed On November 21, 2018 Danske Bank whistleblower Howard Wilkinson testified before the European Parliament. His PowerPoint presentation has been made publicly available and is linked here: Money Laundering in the EU Banking Sector: what is failing? For the first time the full contents of the nondisclosure agreement (NDA) restrictions placed on Mr. Wilkinson as part of his severance agreement have been made public. According to statements by Danske Bank executives, these types of restrictions are common. Although difficult to confirm, we believe that Mr. Wilkinson's testimony constitutes the first time a European bank whistleblower or employee has publicly disclosed the types of contractual restrictions that hinder whistleblowing at financial institutions and often permits crimes to go undetected for years. Warnings Were Ignored by Danske Bank Officials

Danske Bank Whistleblower Howard Wilkinson, the lone whistleblower in the Danske Bank money laundering scandal, testified at a hearing before the Danish parliament today. There was a frenzy of reporters outside the hearing room looking for comment from Mr. Wilkinson and his whistleblower lawyer, Stephen M. Kohn. Due to warnings from Danske Bank, which explicitly warned him that he could face criminal or civil prosecution for speaking on the money laundering issues, little has been heard from Mr. Wilkinson prior to today’s appearance.

SEC Whistleblower Program Recovered $1.7 Billion in 2018

The Securities and Exchange Commission (SEC) issued its annual report on the SEC Whistleblower Program yesterday. According to the report, 2018 was a “record-breaking year” for the SEC Whistleblower Program. The program gave its largest whistleblower award to date, $84 million. It doled out more money this past year to deserving whistleblowers than it has in all prior years combined, $168 million. SEC Whistleblower disclosures recovered over $1.7 billion to the U.S. Treasury through monetary sanctions, with an estimated $432 million returned to investors. Whistleblowers have been awarded $326 million since the beginning of the SEC Whistleblower Program. Some of those receiving whistleblower rewards were company outsiders and individuals residing overseas. The successes outlined in the report are a clear indicator that paying whistleblower incentives is key to rooting out violations of securities laws. Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Mr. Birkenfeld obtained the largest ever individual qui tam whistleblower award in history, $104 million.

Dedicated to protecting whistleblowers, the National Whistleblower Center (NWC) was founded in 1988 by three experienced whistleblower-rights attorneys, Stephen M. Kohn, Michael D. Kohn and David K. Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC. She currently is the NWC corporate Treasure and serves on its Board of Directors. She founded the whistleblower protection blog, and for years managed many of the NWC's highly successful programs.
