CFTC Whistleblower Reward Program Essential to Enforcement of Commodities Laws

The Commodities Futures Trading Commission (“CFTC” or “Commission”) Division of Enforcement (“DOE”) recently published its second annual report. The report highlights the DOE’s success in prosecuting the most damaging forms of misconduct in the market – from manipulative behavior to commodities fraud, to misappropriation of confidential information. The report included an overview of the CFTC Whistleblower Program. The DOE reports the whistleblower program continued to grow in 2019. The whistleblower reward program received 117 claims for awards. The DOE notes that while not all claims will result in a reward, the assistance that a whistleblower provides is essential. The DOE, “working through its Whistleblower Office, is committed to rewarding the critical assistance provided by qualified whistleblowers—and, at the same time, working to encourage other potential whistleblowers to come forward.” Before 2019, the Commission issued a total of nine awards to commodities fraud whistleblowers. Report Finds Whistleblowers Instrumental to Uncovering Financial Fraud

The Commodity Futures Trading Commission (“CFTC” or “Commission”) recently released the annual report for its whistleblower reward program, stating that it awarded more than $15 million to whistleblowers this past year. Since the Dodd-Frank Act established the CFTC whistleblower program in 2010, it has issued fourteen whistleblower awards totaling approximately $100 Million. The CFTC actions associated with those awards have resulted in sanctions orders totaling more than $800 million. The Commission’s Whistleblower Office (“WBO”) received 455 whistleblower tips and complaints in 2019.  Additionally, whistleblowers submitted 88 supplements to their previous filings.  The total number of whistleblower complaints received in 2019 was down from the past year. However, the WBO explained this to be attributable to increased interest in virtual currencies and the CFTC publicity around them during 2018. SEC Enforcement Report Praises Whistleblowers

The U.S. Securities and Exchange Commission (“SEC”) today released the annual report from its Office of Enforcement confirming the critical role the Dodd-Frank Act whistleblower reward program is playing in protecting investors from fraud. According to today's report, the Enforcement Division confirmed that the SEC whistleblower law: is "very successful" and "whistleblowers have made meaningful contributions to significant cases"; the whistleblower program has "resulted in" "high-quality SEC enforcement actions"; and "led to more than "$2 billion in financial remedies”; The "Commission has recognized" the "importance" of whistleblower "tips”; The SEC has paid whistleblowers "approximately $387 million" in rewards. “Job well done,” according to SEC whistleblower attorney Stephen M. Our Client Received the Largest Whistleblower Reward in World History of $104 Million

Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Mr. Birkenfeld obtained the largest ever individual qui tam whistleblower award in history, $104 million.

Dedicated to protecting whistleblowers, the National Whistleblower Center (NWC) was founded in 1988 by three experienced whistleblower-rights attorneys, Stephen M. Kohn, Michael D. Kohn and David K. Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC. She currently is the NWC corporate Treasure and serves on its Board of Directors. She founded the whistleblower protection blog, and for years managed many of the NWC's highly successful programs.
