SEC Sends Warning about Coronavirus-Related Securities Fraud and Insider Trading

The U.S. Securities and Exchange Commission’s Enforcement Division released a public statement on March 23, 2020, warning that the Commission will investigate and prosecute securities frauds related to the coronavirus crisis.  Since the Coronavirus has struck the United States, the stock market has lost approximately 30% of its value, creating opportunities for illegal SEC insider trading and other securities frauds. In its statement, the Commission warned that investors must be mindful of established disclosure controls and procedures, and insider trading prohibitions. This warning, from Co-Directors of Enforcement Stephanie Avakian and Steven Peikin, came after reports last week alleging Senators sold millions of dollars in stock after a January 24 briefing on the coronavirus. The Department of Justice (DOJ) announced Friday that it would prioritize the investigation and prosecution of Coronavirus, or COVID-19 fraud. The announcement comes as the government earmarks trillions of dollars to respond to the Coronavirus (COVID19) crisis. In the face of a crisis, fraudsters often seek ways to profit while others suffer. Headlines about the lack of proper protective gear for healthcare workers, accusations that U.S. Senators violated insider trading laws, reports that the Chinese government silenced Coronavirus whistleblowers, and warnings of fake scam alerts, are taking a toll on the confidence of the American public. Never has there been a more critical need for oversight of government funding. Whistleblower Advocates Call on Attorney General to Establish Special Anti-Fraud Coronavirus Task Force

The Chairman of the Board of Directors of the National Whistleblower Center has called upon Attorney General William Barr to establish a special task force to combat fraud in federal spending targeted to fight the Coronavirus pandemic. According to the March 16, 2020 letter to Attorney General Barr: “The Department of Justice must take prompt and effective action to prevent fraud in any program designed to combat the Coronavirus.” The letter explained that the qui tam whistleblower provisions of the False Claims Act had held fraudsters accountable for “stealing from disaster sites, selling defective body armor to police, and providing deficient healthcare to Medicaidpatients.” Similar prosecutions may be needed to protect the public’s health and safety during the Coronavirus crisis. Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Mr. Birkenfeld obtained the largest ever individual qui tam whistleblower award in history, $104 million.

Dedicated to protecting whistleblowers, the National Whistleblower Center (NWC) was founded in 1988 by three experienced whistleblower-rights attorneys, Stephen M. Kohn, Michael D. Kohn and David K. Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC. She currently is the NWC corporate Treasure and serves on its Board of Directors. She founded the whistleblower protection blog, and for years managed many of the NWC's highly successful programs.
