Attorney General Supports Increased Whistleblower Protections Under Federal Banking Laws FIRREA

New York City, New York. September 17, 2014. In a speech delivered today at New York University School of Law, U.S. Attorney General Eric Holder publicly endorsed enlarging U.S. whistleblower reward laws to include expanded rewards under the Financial Institutions Reform, Recovery, and Enforcement Act, better known as “FIRREA.” The Attorney General acknowledged the tremendous success of other whistleblower reward laws, explaining how incentivizing whistleblowers would “significantly improve the Justice Department’s ability to gather evidence of wrongdoing while complex financial crimes are still in progress – making it easier to complete investigations and to stop misconduct before it becomes so widespread that it foments the next crisis.” Stephen M. The U.S. Chamber of Commerce has initiated an extensive lobbying campaign to undermine America's most successful whistleblower law, the False Claims Act. Beginning in October, 2013 when the Chamber of Commerce release a report entitled, “Fixing the False Claims Act: the Case For Compliance-Focused Reforms,” the Chamber has extensively lobbied Congress to strip millions of Americans from coverage under the False Claims Act, limit damages, increase the burden of proof on demonstrating fraud and create barriers to block employees from contacting the Justice Department with information on contracting fraud. Shortly thereafter, George Mason University’s Center for Law and Economics sponsored a Congressional briefingon the Chamber’s proposals. Whistleblower Came to SEC After Reporting Internally and Company Failed to Take Action On August 29, 2014, The Securities and Exchange Commission announced a whistleblower award of more than $300,000 to a company employee who performed audit and compliance functions and reported wrongdoing to the SEC after the company failed to take action when the employee reported it internally. It’s the first award for a whistleblower with an audit or compliance function at a company. “Individuals who perform internal audit, compliance, and legal functions for companies are on the front lines in the battle against fraud and corruption. Our Client Received the Largest Whistleblower Reward in World History of $104 Million

Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Mr. Birkenfeld obtained the largest ever individual qui tam whistleblower award in history, $104 million.

Dedicated to protecting whistleblowers, the National Whistleblower Center (NWC) was founded in 1988 by three experienced whistleblower-rights attorneys, Stephen M. Kohn, Michael D. Kohn and David K. Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC. She currently is the NWC corporate Treasure and serves on its Board of Directors. She founded the whistleblower protection blog, and for years managed many of the NWC's highly successful programs.
