CFTC Whistleblower Program Sees Huge Increase in Tips and Awards

According to a report released on November 2, 2020, the Commodities Futures Trading Commission (“CFTC” or “Commission”) saw a 126% increase in whistleblower tips during 2020. The Commission issued 11 final orders granting 16 whistleblowers awards in 2020, more than doubling the total awards given during 2019. The CFTC whistleblower reward program was established by the 2010 Dodd Frank Act to protect the U.S. economy and the American public. The program pays monetary awards to qui tam whistleblowers who provide information that leads the CFTC to bring a successful enforcement action exceeding a million dollars for violations of the Commodity Exchange Act. In its annual report to Congress for FY 2020, the Commission detailed the whistleblower program's success, noting it granted 16 applications for whistleblower awards, totaling approximately $20 million.  These awards were paid to individuals who voluntarily provided original information or analyses that led to successful enforcement actions. Today, during a virtual ceremony, Danske Bank whistleblower Howard Wilkinson was chosen as a joint winner of the Allard Prize for International Integrity. The Allard is awarded to individuals, a group, or an organization that demonstrates exceptional leadership and courage in protecting human rights while upholding the Rule of Law, promoting transparency and fighting corruption. The $100,000 CAD Prize was established in 2012 and is one of the world's largest anti-corruption prizes. Wilkinson will share the 2020 prize with Daphne Caruana-Galizia. Previous recipients include Anna Hazare -2013 (India), John Githongo - 2015 joint winner (Kenya), Rafael Marques de Morais - 2015  joint winner (Angola), Khadija Ismayilova 2017 (Azerbaijan), and William (Bill) Binney – 2019 Lifetime Achievement Award (United States). On September 28, 2020, the U.S. Securities and Exchange Commission issued its 100th whistleblower award since the inception of its Dodd-Frank Act whistleblower reward program.  This award also marks the 33rd award given in 2020. These 100 whistleblowers, almost all of whom are confidential and anonymous, have changed Wall Street forever.  Their ability to detect frauds and assist in the successful prosecution of securities law violations demonstrates the invaluable role whistleblowers play in protecting investors and ensuring accountability. Our Client Received the Largest Whistleblower Reward in World History of $104 Million

Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Mr. Birkenfeld obtained the largest ever individual qui tam whistleblower award in history, $104 million.

Dedicated to protecting whistleblowers, the National Whistleblower Center (NWC) was founded in 1988 by three experienced whistleblower-rights attorneys, Stephen M. Kohn, Michael D. Kohn and David K. Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC. She currently is the NWC corporate Treasure and serves on its Board of Directors. She founded the whistleblower protection blog, and for years managed many of the NWC's highly successful programs.
