SEC Awards Whistleblower $600,000 in First Retaliation Case

On April 28, 2015, the Securities and Exchange Commission announced an award to a whistleblower of $600,000. The whistleblower was given the award for providing key original information that led to a successful enforcement action in connection with In the Matter of Paradigm Capital Management, Inc. and Candace King Weir, File No. 3-15930 (June 16, 2014). The whistleblower in this matter suffered unique hardships, including retaliation, as a result of reporting to the SEC. The SEC charged Paradigm with retaliating against the whistleblower after the firm learned that the whistleblower reported potential misconduct to the Commission. Paradigm immediately engaged in a series of retaliatory actions against the whistleblower including removing the whistleblower from the whistleblower’s then-current position, tasking the whistleblower with investigating the very conduct the whistleblower reported to the SEC, changing the whistleblower’s job function, stripping the whistleblower of supervisory responsibilities, and otherwise marginalizing the whistleblower. The Department of Justice recently announced the settlements, listed below, in False Claims Act cases. The False Claims Act permits private parties to sue on behalf of the government those who falsely claim federal funds or avoid paying funds owed to the government. The United States may intervene in and take over the lawsuit. The False Claims Act also allows the whistleblower to receive a share of any funds recovered through the lawsuit. The False Claims Act is one of the most powerful tools to combat government contract fraud. Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Mr. Birkenfeld obtained the largest ever individual qui tam whistleblower award in history, $104 million.

Dedicated to protecting whistleblowers, the National Whistleblower Center (NWC) was founded in 1988 by three experienced whistleblower-rights attorneys, Stephen M. Kohn, Michael D. Kohn and David K. Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC. She currently is the NWC corporate Treasure and serves on its Board of Directors. She founded the whistleblower protection blog, and for years managed many of the NWC's highly successful programs.
