U.S. Slow to Tackle Tax Evasion

An article published today in The Economist criticizes the U.S. government’s “crack down” on tax evasion. “America the not so brave” cites to the slow chase of tax evaders exposed by whistleblowers; the botched prosecution of Raoul Weil; the slaps on the wrists of wealthy evaders; and the shoddy treatment of whistleblowers as signs of the absence of “visible progress” in the pursuit of U.S. tax evaders. The article also analyzes the government’s harsh treatment of UBS whistleblower Brad Birkenfeld, who came forward with data to help catch wealthy tax evaders. The article states that the government has yet to act on some of the detailed information given to it by Mr. Birkenfeld. False Claims Act Settlements Announced by DOJ

The Department of Justice recently announced the settlements, listed below, in False Claims Act cases. The False Claims Act permits private parties to sue on behalf of the government those who falsely claim federal funds or avoid paying funds owed to the government. The United States may intervene in and take over the lawsuit. The False Claims Act also allows the whistleblower to receive a share of any funds recovered through the lawsuit. The False Claims Act is one of the most powerful tools to combat government contract fraud. Our Client Received the Largest Whistleblower Reward in World History of $104 Million

Bradley Birkenfeld broke the back of Swiss bank secrecy. He was the first Swiss banker to file a case under the IRS whistleblower law. The results were unprecedented. UBS bank (at the time the largest bank in the world) had to pay a fine of $780 million. They also had to close all known U.S. accounts, and for the first time in history, the bank turned over the names of 4450 U.S. taxpayers for prosecution in the United States. Mr. Birkenfeld obtained the largest ever individual qui tam whistleblower award in history, $104 million.

Dedicated to protecting whistleblowers, the National Whistleblower Center (NWC) was founded in 1988 by three experienced whistleblower-rights attorneys, Stephen M. Kohn, Michael D. Kohn and David K. Colapinto. Mary Jane was selected as the NWC's first Public Interest Law Fellow, and soon became a major leader in the NWC. She currently is the NWC corporate Treasure and serves on its Board of Directors. She founded the whistleblower protection blog, and for years managed many of the NWC's highly successful programs.
